Federal Lawsuit Is Over: On October 23, 2007, a final judgment was entered by the United States District Court in New Jersey after three years of litigation. Paul DeFiroe, Russell J. Lacasse and Maxam Eyewear were defendants in this lawsuit which was brought by Viper, Inc. The Judgment prohibits these defendants from using the IBEAMS trademark and from using the copyrighted Ibeams G-Codes. The Judgment further ordered that the defendants may no longer offer for sale the REPELLER RX, EXCAVATOR RX, MAXAMIZER RX, ACCELERATOR SLIM, ACCELERATOR WIDE, DEFLECTOR, EXCAVATOR, MAXAMIZER or REPELLER eyeglass frames and must turnover to Viper, Inc. all inventory of such frames. The Judgment also ordered the transfer of the ibeams.com domain name to Viper, Inc. Viper will be selling off the inventory of frames received pursuant to the Judgment until they are gone.
